การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาสภาพปัญหาและอุปสรรคในการบังคับใช้กฎหมายตามพระราชบัญญัติมาตรการในการปราบปรามผู้กระทำความผิดเกี่ยวกับยาเสพติด พ.ศ. 2534 2) เปรียบเทียบมาตรการทางกฎหมายระหว่างพระราชบัญญัติมาตรการใน
การปราบปรามผู้กระทำ ความผิดเกี่ยวกับยาเสพติดพ.ศ. 2534 กับ (ร่าง) ประมวลกฎหมายยาเสพติด พ.ศ..... และ (ร่าง) พระราชบัญญัติวิธีพิจารณาคดียาเสพติด (ฉบับที่....) พ.ศ..... และ 3) เสนอแนะการพัฒนามาตรการตามกฎหมายฯ และพัฒนาประสิทธิภาพในการบังคับใช้มาตรการตามกฎหมายฯ โดยพิจารณา 2 มิติ ได้แก่ มิติด้านเนื้อหาในตัวบทกฎหมาย
ตามพระราชบัญญัติมาตรการในการปราบปรามผู้กระทำความผิดเกี่ยวกับยาเสพติด พ.ศ. 2534 ในส่วนที่เป็นการกำหนดความผิดฐานสมคบตาม (มาตรา 8) ความผิดฐานสนับสนุนช่วยเหลือ (มาตรา 6) และในส่วนที่เป็นขั้นตอนและกระบวนการในการปฏิบัติ ได้แก่ 1) การขออนุมัติจับกุมหรือการแจ้งข้อหา (มาตรา 14) การตรวจสอบทรัพย์สิน (มาตรา 15 – 33) 2) และมิติด้านกาบังคับใช้กฎหมายของเจ้าหน้าที่รัฐตามมาตราดังกล่าว ทั้งนี้ ระเบียบวิธีวิจัยได้อาศัยระเบียบวิธีวิจัยเชิงคุณภาพ โดยการเก็บรวบรวมข้อมูล 4 วิธีการ ได้แก่ 1) การศึกษาเอกสาร การสัมภาษณ์เชิงลึก การสนทนากลุ่ม และการสัมมนาอภิปรายผลกาวิจัย ซึ่งกลุ่มผู้ให้ข้อมูลในการสัมภาษณ์ประกอบด้วย 3 ระดับ ได้แก่ 1) ระดับผู้กำหนดนโยบาย
2) ระดับผู้เชี่ยวชาญ และ 3) ระดับเจ้าหน้าที่ผู้ปฏิบัติ ผู้ให้ข้อมูลของการจัดกลุ่มสนทนาเฉพาะประเด็น (Focus Group) เป็นเจ้าหน้าที่ผู้ปฏิบัติในพื้นที่กรุงเทพมหานคร และภาค
1 – 9 และผู้เข้าร่วมการสัมมนาอภิปรายผลกาวิจัย ประกอด้วย ผู้บริหาร ผู้ทรงคุณวุฒิและ
ผู้มีส่วนเกี่ยวข้องในการบังคับใช้กฎหมาย จากหน่วยงานที่เกี่ยวข้องทั้งในกรุงเทพมหานครและส่วนภูมิภาครวมถึงผู้ที่อาจได้รับผลกระทบจากมาตรการพิเศษตามกฎหมาย

This research purposes to: 1) study in the conditions of problems and obstacles for law enforcement in accordance with the Act on the Measures for the Suppression of Offenders in an Offence Relating to Narcotics, B.E. 2534; 2) compare the legal measures between Act on the Measures for
the Suppression of Offenders in an Offence Relating to Narcotics, B.E. 2534 and Draft Narcotics Code B.E. ……….. and Draft Drug Case Procedure Act (No. ………) B.E. ………. and; 3) recommend the development of legal measures and efficiency of legal measure enforcement. The consideration was made in
two dimensions: the dimension regarding the contents of statute in accordance with Act on the Measures for the Suppression of Offenders in an Offence Relating to Narcotics, B.E. 2534 in the section of conspiracy (Section 8) and support and assistance (Section 6) offence stipulation, and the section of procedures and practices: request for approval in apprehension and accusation notification (Section 14), property examination (Section 15-33) and; the dimension regarding law enforcement of the government officer in accordance with the Sections above. In this regard, the research methodology relying on the qualitative research was conducted by these following data collections: 1) document study, in-depth interview, group conversation, and the result discussion seminar. The respondents who participated in the interviews were classified in 3 levels: 1) policy stipulators; 2) expert and; 3) operating officer. The respondents of the focus group were operating officers working in the area of Bangkok Metropolis and Region 1-9. The participants for result discussion seminar consisted of the executives, qualified persons, and the persons relating to law enforcement, from the relevant Bangkok and provincial authorities including the person who might be affected by the special legal measures.
